STUDENT ENROLMENT TERMS AND CONDITIONS

The undersigned student wishing to engage the services of On Traxx Motorcycle Training & tours ("On Traxx") hereby acknowledges that he/she shall be bound by the terms and conditions hereinafter set forth.

Class 6 applicants:

(a) Must have outstanding court fines, Monies owing to ICBC, or any outstanding parking tickets paid in order to obtain proper licensing.
(b) Class 6 licence applicants who have acquired a Class 5 prior to August 1, 1998
Need not have completed the Graduated Licensing Program.
(c) Must have parental consent if under the age of nineteen years old.

Failure to Meet Admission Requirements:

(a) If the applicant fails to meet the above noted requirements, admission to the training program may be denied.
(b) If a student fails to meet the minimum admission requirements and is still wishing to be admitted, the student holds On Traxx blameless should the student fail to satisfactorily complete the program of study.
(c) Where a student represents to On Traxx that he/she meets the minimum requirements for admission but it turns out that he/she does not meet the minimum requirements there will be no refund of any fee paid to On Traxx.

Administrative Charges:

(a) Duplicates or replacement Income Tax Receipts, Certificates, transcripts, or Course Outlines are each subject to a $25.00 fee.
(b) All refunds as herein provided are subject to a $25.00 fee.

Payment Policies:

(a) Payments to be made in full before course starts.
(b) Payments may be paid by cash, Visa, MasterCard, or Interact.

Rescheduling Policies:

(a) Due to the comprehensive content of the training schedule, rescheduling must be kept to a minimum.
(b) 48 hour notice prior to the scheduled lesson must be given during office hours Monday to Friday 9:00 am to 4:30 PM for the rescheduling of the lesson.
(c) For weekend changes, notice must be given by 4:30 PM Thursday, or lessons will be forfeited.
(d) Rescheduling Should be made through the office Two Weeks in advance, as these spots fill up quickly.

Student Responsibilities:

(a) To obtain the appropriate learner's permit before the course start date. (Do not leave it up to the last minute. ICBC will only allow you to write ONE learner's exam per business day.)
(b) To complete all exams required by ICBC.
(c) To pay all fees required by ICBC.
(d) To make all necessary payments to On Traxx.
(e) Attend all scheduled dates arranged with On Traxx unless otherwise notified.

On Traxx has the right to:

(a) Charge for training should a student not arrive for scheduled training without giving 48 hour notice.
(b) Charge for training if the student arrives with no learner's permit.
(c) Charged the student for missed or forfeited lessons.
(d) Cancel the Road Test if the Instructor feels the student is not ready to take the final exam.
(e) Reschedule Theory Classes if not enough students are registered.

Student Dismissal Policies and Procedures:

(a) If any student displays inappropriate behaviour or acts in an unsafe manner that is detrimental to any employee or other student(s) taking training with On Traxx, On Traxx has the right to dismiss the student in question. Refund policies will be strongly enforced.
(b) There will be ABSOLUTELY ZERO TOLERANCE related to the use of alcohol, drugs, and/or any other such substances in, on, or around any On Traxx facility or vehicle. Any student in breach of contract shall be immediately dismissed Without Refund.

Dispute Resolution Policy:

(a) All disputes made by a student of On Traxx must be made in a written submission to On Traxx.
(b) On Traxx will respond to all such disputes in writing outlining the justification for all decisions.

Refund Policy:

Refunds in case of withdrawal or Dismissal:

Written notice must be provided by:
(a) A student to On Traxx where the student withdraws.
(b) On Traxx to the student where the Institution dismisses the student.

Where total fees have not yet been collected, if a refund is required by On Traxx, On Traxx is not responsible for refunding more than what has been collected.

Refunds prior to the start of a course:

(a) Cancellation by the student 14 days or more prior to the scheduled course date, On Traxx will refund the course fee paid by the student however On Traxx is authorized to charge a $25.00 administration fee for the processing of a refund.
(b) Cancellation by the student 3 - 13 days prior to the scheduled course date, On Traxx will refund 50% of the course fee less the $25.00 administration fee.
(c) Cancellation by the student 48 hours or less prior to the scheduled course date and/or non-attendance on the course date, NO REFUND WILL BE PAID.

Refunds after the start of a course:

(a) There will be NO REFUND AFTER THE START DATE OF THE SCHEDULED COURSE.
(b) Transfer to an alternative course date is subject to available space and is also subject to On Traxx's written approval. All such transfers must be with a minimum 48 hour notice prior to the scheduled course date and will be subject to a $25.00 administration fee.

Miscellaneous:
(a) Certification does not guarantee ICBC will issue licence or that a student will pass the ICBC skills test or ICBC road test.
(b) ICBC may require a Certified Trainee to be retested by ICBC.
(c) ICBC may want access to trainee's training and assessment records and the student hereby irrevocably authorizes On Traxx to provide ICBC with such records.

Waiver:

THE UNDERSIGNED STUDENT UNDERSTANDS AND ACCEPTS THE RISKS OF RIDING A MOTORCYCLE. ALTHOUGH THE STUDENT WILL BE ACCOMPANIED BY AN ON TRAXX CERTIFIED INSTRUCTOR DURING THE COURSE THE STUDENT ACCEPTS THE FACT THAT COMMUNICATION BETWEEN MOTORCYCLES CAN BE DIFFICULT. THE STUDENT AGREES TO FOLLOW ALL OF THE INSTRUCTIONS AND DIRECTIONS GIVEN BY THE ON TRAXX INSTRUCTOR AND SHOULD THE STUDENT AND THE ON TRAXX INSTRUCTOR BECOME SEPARATED THE STUDENT AGREES TO STOP HIS/HER MOTORCYCLE AT THE FIRST OPPORTUNITY THAT IS SAFE TO DO SO AND TO WAIT FOR THE ON TRAXX INSTRUCTOR. THE STUDENT AGREES AT ALL TIMES WHILE RIDING THE MOTORCYCLE DURING THE COURSE TO OBEY ALL SPEED LIMITS AND OTHER TRAFFIC RULES. THE STUDENT ASSUMES FOR HIMSELF/HERSELF AND HIS/HER HEIRS, EXECUTORS, ADMINISTRATORS, AND PERSONAL REPRESENTATIVES ALL RISK OF PERSONAL INJURY, DEATH OR PROPERTY LOSS RESULTING FROM ANY CAUSE WHATSOEVER INCLUDING BUT NOT LIMITED TO THE INHERENT RISK OF RIDING A MOTORCYCLE WHILE IN THE COURSE AND IN PARTICULAR INJURIES RESULTING FROM COLLISION WITH EITHER MOVING OR FIXED OBJECTS (INCLUDING BUT NOT LIMITED TO OTHER MOTOR VEHICLES), ANY ACCIDENT OCCURRING AS A RESULT OF ANY DEFECT OF ANY MOTORCYCLE THAT MAY BE SUPPLIES BY ON TRAXX FOR USE BY THE STUDENT DURING THE COURSE OR ANY ACCIDENT RESULTING FROM THE NEGLIGENCE ON THE PART OF ON TRAXX. ON TRAXX SHALL NOT BE LIABLE FOR ANY SUCH PERSONAL INJURY, DEATH OF PROPERTY LOSS AND THE STUDENT HEREBY RELEASES ON TRAXX, STEVEN RUSSELL TOWNSEND AND ANY OTHER INSTRUCTORS OR EMPLOYEES OF ON TRAXX AND WAIVES ALL CLAIMS AGAINST THEM WITH RESPECT THERETO.
